Booking Conditions

These are the terms and conditions which will apply to your expedition. Please read all the terms and conditions, including any contained in the Booking Form overleaf carefully, as you will be bound by them.

1. All bookings are made with Global Action Ltd (also herein referred to as “we” or “us”) and shall be valid only if accepted after receipt by Global Action Ltd of the completed Booking Form and deposit of £400 per person – or such higher amount as may be determined by Global Action Ltd - and after confirmation of the booking has been sent to you. This deposit is non-refundable as it covers deposits for: international flights, in-country transportation and accommodation, travel insurance, school visits and workshops, in-country visits, extensive itinerary planning, risk assessments and other essential administrative expenses in respect of the expedition.

2. A second payment of at least £995 (for trips to Nepal, India, Costa Rica and Zanzibar), or £450 (for trips to Switzerland), must be paid eight months prior to departure. If this second payment is not paid in time we reserve the right to cancel your expedition, and retain your deposit.

3. The balance of the price of your expedition must be paid at least ten weeks before departure date. If the balance is not paid in time we reserve the right to cancel your expedition, retain your deposit and apply cancellation charges set out below.

4. If, after confirmation has been issued, you wish to make alterations to your expedition, we will make all reasonable endeavours to apply the requested changes, provided that notification is received at our offices at least eight weeks before departure. This must be accompanied by a non-refundable payment of £65 to cover administration costs. These charges will be payable whether or not Global Action Ltd is successful in confirming the requested alterations. Any alteration by you within eight weeks of departure will be treated as a cancellation of the original booking and will be subject to cancellation charges set out below.

5. You, as a member of your party, may cancel your expedition at any time providing that the cancellation is made by the person signing the booking form and is communicated to us in writing. Written cancellations are effective from the day they are received by Global Action Ltd. As this incurs administrative costs (see Paragraph 1) we will retain your deposit. In addition we will apply cancellation charges as shown below.

6. Expeditions are based on air travel from London back to London (unless otherwise specified) on the dates specified, and no reductions or refunds can be made in respect of unused tickets in either or both directions.

7. Group tours are costed on a minimum number of passengers travelling together. If this minimum level is not reached we will either cancel the departure and offer a refund in full or, subject to your agreement, we will operate the expedition at such rate of supplement per person as conclusively determined by Global Action Ltd.

8. Global Action Ltd acts only as agents for the owners of accommodation and services provided, for all carriers by air or otherwise and for road transport proprietors. All bookings are accepted subject to the ticket or transport conditions and regulations of the relevant carriers or transport proprietors, and are also subject to the laws of the country in which such carriage or other facility is provided.

9. Neither Global Action Ltd nor the owners of the services provided will entertain any complaint unless written notice is received by Global Action Ltd within 7 days of the final day of the expedition.

10. Bookings are accepted subject to the services being available. All prices or other charges are based on prevailing costs as indicated in our outline itinerary and any aviation fuel surcharges at that date are subject to revision without notice in the event of any increase in these costs. If, at the date the balance of the price of your expedition is payable by you, the price has increased by more than 20% of the price of the expedition, you will be entitled to cancel the booking upon giving prompt written notice.

11. In the event of adverse movements in the rate of exchange between the £ sterling and any relevant foreign currency, you shall pay a surcharge calculated on the direct extra cost to Global Action Ltd as a result of that change as conclusively determined by Global Action Ltd. An account showing any such surcharge due will be sent to you not later than six weeks before departure date and shall be paid within 7 working days.

12. Neither Global Action Ltd nor the proprietors of any accommodation or service provided shall be under any liability for any inconvenience, damage, loss, accident, delay or accidental expense howsoever caused, occasioned to, or incurred by any other passenger or any other person due to circumstances beyond their control.

13. Medical examinations, vaccinations, obtaining personal travel insurance (if applicable), visas and other preliminary arrangements are entirely your responsibility. Global Action Ltd accepts no responsibility in the event that these arrangements are not completed in time for departure and in which event no refunds will be paid by us.

14. Global Action Ltd cannot be held responsible for any loss, damage or accident to any luggage and property. They are at all times carried at their owner’s risk, even when carried by porters or pack animals.

15. While Global Action Ltd will use all reasonable endeavours for your comfort and enjoyment, it reserves the right at any time to modify or cancel without prior notice the tour, itinerary, travel arrangements or accommodation if affected by unforeseen circumstances such as those described in paragraph 16 below. In such case, no liability whatsoever shall fall on Global Action Ltd.

16. The outline itinerary given must be taken as an indication of what each group hopes to achieve and not as a contractual obligation on the part of Global Action Ltd. It is a necessary condition of your joining any of our expeditions that you accept this flexibility and that you also accept that we cannot be held responsible for any injury, illness, death, loss (as defined below), damage, expense, cost or other sum or claim of any description whatsoever which results directly or indirectly from any of the following (which is not intended to be an exhaustive list):-

a. Delays or alterations in the programme owing to ‘circumstances beyond our control’ (as defined below);

b. The act(s) and/or omission(s) of the person(s) affected or any member(s) of their group including self-inflicted injury (except where trying to save human life), injury caused by such person(s) or member(s) negligence or failure to follow local laws or regulations and injury occurring to such person(s) or member(s) whilst under the influence of drink or drugs; or

c. The act(s) and/or omission(s) of a third party not connected with the provision of your expedition and which were unforeseeable or unavoidable

d. In these Booking Conditions the following words and phrases shall have the meaning ascribed thereto as follows: ‘loss’ means any liability of Global Action Ltd in contract, tort (including negligence or breach of statutory duty) or otherwise, howsoever and whatsoever the cause thereof for any (i) loss of earnings, profit, business, revenues or anticipated savings, or, (ii) any special indirect or consequential damage of any nature.

'Circumstances beyond our control' means any event which we or the supplier of the service(s) in question could not, even in all due care, foresee or avoid. Such events include:- international or domestic flight cancellation, actual or threatened war, political closures and disputes, riot, civil strife, strikes, terrorist activity and its consequences (including suspected terrorist activity and all action taken during “terror alert”), industrial dispute, local regulations, sickness, quarantine, nuclear disaster, epidemics and pandemics, natural disasters, weather conditions, unavoidable technical problems with transport, fire, acts of local or national Government, default of suppliers or subcontractors, or any circumstances amounting to force majeure and/or acts of God, and all similar events outside our control. The Applicant’s booking is accepted by Global Action Ltd on the understanding that the Applicant and Parent/Guardian appreciate the possible risk inherent in adventure travel, and acknowledge that the Applicant undertakes the expedition at his/her own risk and volition.

17. Global Action Ltd will use reasonable skill and care in arranging each programme. In order to succeed in a claim against Global Action Ltd for any loss, the Applicant must establish that Global Action Ltd has not used reasonable skill and care in arranging the programme. The question of whether Global Action Ltd has provided the services, facilities and activities it organises and makes available to the Applicant with the necessary skill and care shall be assessed with reference to the laws and regulations applicable in the Destination country in which they are provided. In accordance with paragraph 9, Global Action Ltd’s liability to the Applicant or the Applicant’s parent or guardian in respect of this arising from a programme in any event, and howsoever incurred, shall be limited to the sum of the in-country cost paid by the Applicant. The in-country cost includes: accommodation, food, all activities, local guides, and local transport. The in-country cost excludes: international flights, passenger service charges, departure taxes, costs for the UK expedition leader and school staff, personal insurance, medical screening, group equipment, and Global Action Ltd’s costs that include: pre-departure workshops, administrative planning and all bookings, as described in paragraph 1.

18. All baggage and personal effects are at all times at your sole risk.

19. This contract and any dispute or claim arising out of or in connection with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with English law and you irrevocably agree to submit to the exclusive jurisdiction of the English courts. Any such disputes or claims not amicably resolved shall be referred to arbitration under the provisions of the Arbitration Act 1996.

20. Global Action Ltd, in conjunction with the Medical Advisor and/or leader if applicable, has the right to withdraw any passenger prior to departure, or during the expedition, if considered necessary for the medical well-being or safety of the individual or the group without the right to any refund. The decision of Global Action Ltd is final.

21. Because the majority of our expeditions are individually tailored, it is not possible to include information in our outline itinerary on the destination airport, airline operator and aircraft type to be used.

22. When you buy an Air Travel Organiser’s Licencing (“ATOL”) protected flight or flight inclusive holiday from us you will receive an ATOL Certificate. This lists what is financially protected, where you can get information on what this means for you and who to contact if things go wrong.

23. Global Action Ltd, or the suppliers identified on your ATOL Certificate, will provide you with the services listed on the ATOL Certificate (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency, an alternative ATOL holder may provide you with the services you have bought or a suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative ATOL holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative ATOL holder. However, you also agree that in some cases it will not be possible to appoint an alternative ATOL holder, in which case you will be entitled to make a claim under the ATOL scheme (or your credit card issuer where applicable).

24. If Global Action Ltd, or the suppliers identified on your ATOL certificate, are unable to provide the services listed (or a suitable alternative, through an alternative ATOL holder or otherwise) for reasons of insolvency, the Trustees of the Air Travel Trust may make a payment to (or confer a benefit on) you under the ATOL scheme. You agree that in return for such a payment or benefit you assign absolutely to those Trustees any claims which you have or may have arising out of or relating to the non-provision of the services, including any claim against us, the travel agent (or your credit card issuer where applicable). You also agree that any such claims may be re-assigned to another body, if that other body has paid sums you have claimed under the ATOL scheme.
